Child Custody

Divorce and Family

In October 2010, New York implemented the concept of “no-fault divorce,” allowing couples to seek divorce without having to prove fault-based grounds. Our firm guides clients with financial breakup, including equitable distribution of marital debts and assets as well as with support and custody matters. New York divorces required establishing fault through reasons such as cruel and inhuman treatment, abandonment for one year or more, adultery, prolonged imprisonment, or the conversion of a separation agreement after living apart for a year or more. This revision also eliminated the requirement for uncontested divorces to be based on fault grounds.

Residential Real Estate

Our firm will provide representation for either sellers or purchasers in Residential Real Estate matters from contracts through closing. Same Sex Divorce

Following the Supreme Court’s recognition of the constitutional equal rights of same-sex couples to marry, states are now required to recognize same-sex marriages. This means that same-sex divorce cases in New York adhere to the same rules and regulations as any other divorce. Theresa A. Mari, P.C. is experienced in handling all divorce and family law issues in New York, including same-sex divorce. Our attorneys possess in-depth knowledge of New York Law and provide dedicated representation to our same-sex divorce clients, ensuring their rights and interests are protected throughout the process.

Spousal Maintenance

Formally known as Alimony, spousal maintenance provides financial support from the monied spouse to the non-monied spouse to enable the non-monied spouse to become self-supporting. Spousal maintenance is based on a statutory formula of approximately 15 factors that a Court can consider to determine if the award of spousal maintenance is just and proper. At Theresa A. Mari, P.C., our attorneys possess extensive experience in litigating both temporary spousal maintenance, which is paid during the divorce process, and permanent spousal maintenance, which is paid after the divorce. We are well-versed in the complexities of determining the appropriate amount and duration of spousal maintenance and are committed to advocating for your best interests throughout the legal proceedings.

Child Support

Parents have a statutory obligation to support children in New York State until the child reaches the age of 21 or is otherwise emancipated. Based on a statutory calculation, child support is generally paid by the non-custodial parent. If parents have a shared parenting time arrangement, then the monied party will be the payor of child support.

Mediation

Mediation is an alternate form of dispute resolution which bypasses the need for litigation. A mediator is a neutral third party that does not represent either party, but acts as both facilitator and scrivener to an agreement that is a collaborative effort.
